How do I use Gen AI with Patent Bots?

IMPORTANT!  Transition to Zero Data Retention

  • Our original implementation of Gen AI used OpenAI GPT models.  Despite numerous requests, OpenAI has not granted us zero data retention.  Because of this, we are switching to AWS Bedrock with Llama models and zero data retention.
  • Effective October 2025, you can enable zero data retention with Patent Bots:
    • If you have not previously enabled Gen AI at Patent Bots and enable it now, you will have zero data retention with AWS Bedrock.
    • If you have previously enabled Gen AI at Patent Bots, you will continue to use the OpenAI models without zero data retention.  Your subscription admin can migrate to zero data retention with AWS Bedrock at any time from our subscription settings page.
    • On Nov. 30 2025, we will disable OpenAI without zero data retention permanently.  After this date, our Gen AI tools will not be available unless you switch to zero data retention with AWS Bedrock.

Patent Bots Gen AI Tools

Patent Bots currently has three tools that use Gen AI.

Draft Title, Background, and Abstract

Our Word add-in patent application drafting tools can draft a title, background section, and abstract for your patent application.  The generation is based on claim 1.  You need to insert these placeholders in your Word document:

We will replace these placeholders with text generated with Gen AI.  The processing takes about 30 seconds.

OA Summary

Our Office Action Admin tool can generate a summary of your most recent office action.  We have an {{OA_SUMMARY}} placeholder that you can put in any of your templates.  The generation is based on the text of your most recent office action and we generate a summary that includes the rejections present in the office action.

PatentPlex Gen AI Agents

PatentPlex has two Gen AI agents for asking questions about patents:

  • Patent/IFW -- This agent allows you to ask questions about a patent and its file history.  We create an agent that has access to the following information:
    • The issued patent, if it exists, or the published application.
    • All office actions.
    • All versions of the claims from the file history.
    • All remarks that accompany office action responses.
  • Patent/Family -- This agent allows you to ask questions about a patent and the claims of family members.  We create an agent that has access to the following information:
    • The issued patent, if it exists, or the published application.
    • The claims of all US non-provisional, European, and PCT patents.  The issued claims are used if available and the published claims otherwise.

Enabling Gen AI for your Subscription

Gen AI features are turned off by default and must be enabled by a your subscription admin.  

  • Allow Gen AI for Drafting -- This enables Gen AI to draft the title, background, and abstract.
  • Allow Gen AI for Non-Drafting -- This enables Gen AI for OA Admin and PatentPlex.
There are no additional fees for enabling or using Gen AI features.

AWS Bedrock Terms and Security

AWS Bedrock provides a secure environment for use of Gen AI:

Cloud security at AWS is the highest priority. As an AWS customer, you benefit from data centers and network architectures that are built to meet the requirements of the most security-sensitive organizations. (link)

AWS Bedrock provides zero data retention by default and does not train models on customer data:

Amazon Bedrock doesn't store or log your prompts and completions. Amazon Bedrock doesn't use your prompts and completions to train any AWS models and doesn't distribute them to third parties. (link)

OpenAI Terms and Security

Please review the OpenAI API data usage policies before enabling GPT in Patent Bots. You are responsible for determining if OpenAI policies meet your needs.

As of May 24, 2023, the OpenAI API data usage policies state:

  • The OpenAI API is SOC 2 Type 2 compliant and has been audited by an independent third-party auditor against the 2017 Trust Services Criteria for Security.
  • OpenAI will not use data submitted by customers via our API to train or improve our models, unless you explicitly decide to share your data with us for this purpose. You can opt-in to share data. [Patent Bots has not and will not opt-in.]
  • Any data sent through the API will be retained for abuse and misuse monitoring purposes for a maximum of 30 days, after which it will be deleted (unless otherwise required by law).
  • A limited number of authorized OpenAI employees, as well as specialized third-party contractors that are subject to confidentiality and security obligations, can access this data solely to investigate and verify suspected abuse.

OpenAI also states that its servers are currently located in the US.
